Terms of Service

The service

Dexavox provides an AI receptionist that answers your business phone, answers questions, takes bookings and messages, and can transfer a caller to a person. You configure how it behaves; we run it.

Your account

You must give accurate information when signing up and keep your login secure. You are responsible for everything done through your account. You must be authorised to act for the business you register.

Your responsibilities

Because the service speaks to your customers in your name, some things stay with you:

• The accuracy of what you tell the agent. Prices, hours, policies, and answers come from your setup; the agent repeats them.
• Compliance with the laws that apply to recording telephone calls where you and your callers are located. We announce recording automatically where all-party consent is required, but you remain responsible for your own compliance.
• Any personal or health information you upload, including the lawful basis for uploading it and the accuracy of it.
• Reviewing bookings, messages, and transcripts. The agent is an assistant, not a substitute for your judgement.

Acceptable use

You may not use the service to:

• Break the law, or help anyone else do so.
• Make unsolicited or automated outbound calls, or anything that would breach telemarketing rules.
• Impersonate another business or person.
• Attempt to access another customer's data, disrupt the service, or reverse-engineer it.

Emergencies

The service is not an emergency service and must not be relied on as one. It cannot dial emergency numbers. Configure your agent to direct urgent medical, safety, or security matters to a person or to the appropriate emergency number.

Third-party services

The service depends on third parties including telephone carriers, speech and language model providers, and — where you connect them — Google and your practice-management system. Interruptions at those providers can interrupt the service. Where you connect your own account at a third party, that provider's own terms also apply to you.

Fees and trials

Paid plans, trial length, included minutes, and overage rates are those shown at signup or on our pricing page at the time you subscribe. Telephone and usage charges accrue as you use the service. We will give notice before changing prices for an existing subscription.

Your content

Everything you upload, and everything your callers say, remains yours. You grant us the licence needed to host and process it in order to run the service for you. We do not use your content or your callers' content to train generalised AI models.

Our software

The Dexavox software, interface, and brand remain ours. These terms grant you the right to use the service, not to own any part of it.

Availability and disclaimers

We work to keep the service running and accurate, but it is provided as is. Automated speech recognition and language models make mistakes: they can mishear a name, misunderstand a request, or answer imperfectly. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits or lost business, arising from the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Ending the agreement

You can cancel at any time from the dashboard. We may suspend or end an account that breaches these terms, or on notice if we stop offering the service. When an account closes we release any phone number we provisioned for you, and delete your data as described in the Privacy Policy. Export anything you want to keep first.

Changes to these terms

We may update these terms. If a change materially affects your rights, we will notify account holders by email before it takes effect. Continuing to use the service after that means you accept the change.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules.
